Ukraine Seeks WTO Intervention Over Grain Embargo Imposed by Poland and Slovakia

Ukraine’s Official Appeal to the WTO

Following the recent unilateral imposition of an embargo on Ukraine by Poland and Slovakia, which defied the lifting of the European Union embargo, Ukraine has lodged an official complaint with the World Trade Organization (WTO). Warsaw had announced its decision to extend the blockade independently, leading to Kyiv’s immediate response.

WTO Dispute Resolution Procedure

The dispute procedure within the WTO is primarily negotiation-based. These mandatory negotiations can last for up to 60 days. If no resolution is achieved within this period, the complainant can appeal to the WTO’s Dispute Settlement Body (DSB). The DSB, comprising representatives from all WTO member countries, establishes an expert panel. This panel will analyze data, consult with experts, and present a draft report to the parties. After considering their comments, the panel will announce a final report, which will then be submitted to the DSB for acceptance.

The panel is expected to present its report within nine months, although this period can be shortened to three months in extremely urgent cases. It is anticipated that the direction of this dispute will be known by the end of the calendar year. The panel has the authority to determine whether the claims are unfounded or justified. If the aggrieved party fails to execute the report, they may seek the imposition of retaliatory tariffs intended to compensate for the loss caused by actions prohibited by international law. However, the WTO does not impose financial penalties.

Possible WTO Decisions and Repercussions

If the WTO agrees with Ukraine, it may call for the lifting of the import ban. If this does not occur within the expected time frame, the WTO may allow for retaliatory tariffs on agricultural products. However, the resolution is somewhat dependent on the strategy adopted by the aggrieved parties.

Ukraine will likely refer to the European Commission’s decision to lift the embargo on September 15, arguing that member states should adjust to this common trade policy. On the other hand, Poland may cite the general premise of national security, as trade agreements typically include general clauses that allow for the protection of one’s market in exceptional situations.

Impact of the Dysfunctional Appellate Body

The dispute can be appealed to a special appellate body. However, this body is currently dysfunctional due to a lack of judges. This situation began during the presidency of Donald Trump and has not been resolved under Joe Biden’s administration. As a result, the WTO is currently not examining over 20 cases filed for appeal. This could also happen to Poland after a possible unfavorable decision by the DSB panel. This could prolong the dispute or leave it unresolved for a longer period.
