Political Tensions Emerge in Malaysia

In a recent turn of events, Malaysian Prime Minister Anwar Ibrahim has defended his position amidst allegations that he influenced the discharge not amounting to acquittal (DNAA) granted to Deputy Prime Minister Datuk Seri Ahmad Zahid Hamidi. The Prime Minister asserts that the decision was not his, but instead the former Attorney General Tan Sri Idrus Harun’s. According to Anwar, Idrus made the decision independently, feeling obligated due to certain reasons and insisted on doing so prior to his retirement.

The Reasons Behind the DNAA

Addressing the controversy surrounding the DNAA, Anwar clarified that while he did inquire about the decision, he did not pressure Idrus to change it. The former Attorney General provided 11 reasons for his decision, which were subsequently presented in court by Deputy Public Prosecutor Datuk Ahmad Dusuki Mokhtar when the DNAA was granted.

Continued Investigation by Anti-Corruption Commission

Following the DNAA, Anwar stated that the Malaysian Anti-Corruption Commission would continue its investigation of Hamidi. If additional evidence is found, charges may still be brought against him. Anwar emphasized his respect for the Attorney General’s discretionary power, as outlined in Article 145(3) of the Federal Constitution, and referred to several precedents where the Attorney General’s discretionary powers were upheld.

Anwar’s Response to Opposition

In response to the Opposition, Anwar reminded them that Idrus was appointed by the previous government and that he did not replace him upon taking office. Anwar also drew attention to other instances where a DNAA was granted after the prosecution had established a prima facie case, including cases involving opposition politicians and high-profile murder suspects.

Public Outcry and Political Fallout

The decision to grant the DNAA has sparked intense public criticism and heated debates in the Malaysian Parliament, leading to a walkout by several Opposition MPs in protest of the Speaker’s decision. Hundreds of people staged an anti-government rally in Kuala Lumpur, accusing the Prime Minister of helping his key ally escape prosecution in exchange for political support. Many protesters wore white shirts emblazoned with the words “Fight Corruption” and chanted phrases such as “Charge Zahid” and “Down with Anwar”.

Continued Legal Entanglements

Beyond the current controversy, Malaysia’s political landscape is fraught with legal complexities. Former Prime Minister Najib Razak is serving a 12-year jail sentence for a separate corruption case related to the 1Malaysia Development Berhad (1MDB) fund, and he also faces several other graft charges. Additionally, former Prime Minister Muhyiddin Yassin was recently acquitted of four corruption charges, further fuelling the political tension in the country.

The ongoing political drama in Malaysia raises questions about the future of the country’s anti-corruption efforts and the integrity of its political institutions. The controversy surrounding the DNAA decision, coupled with the recent acquittal of high-profile politicians, may undermine public confidence in the government’s commitment to tackling corruption.
