The Attorney General (AG) has requested that the Constitutional Court dismissed a petition filed by a municipal lawyer challenging the Judiciary’s bail rules due to a lack of substance.
Mr. Steven Kalali is contesting the new bail rules established by Chief Justice (CJ) Alfonse Owiny-Dollo in June.
He accuses the CJ of abusing administrative authorities, claiming that this should have been the duty of Parliament, which has the constitutional mandate to make legislation.
However, the AG claims that the petition raises no constitutional questions and that the court should not hear such cases, which are exclusively about human rights enforcement.
According to the AG, the bail guidelines were required for the proper and efficient administration of justice and are in accordance with Article 133 of the Constitution.
