The Underpinnings of Poland’s Bridging Pensions

In Poland, the general retirement age is set at 60 for women and 65 for men. However, certain professions are entitled to early retirement, sometimes as much as five years early, with a specific benefit known as a bridging pension. These pensions are designed to act as a transitional lifeline for those who have worked under special conditions or of a unique nature.

A bridging pension, as the name suggests, serves as a bridge between the benefits acquired prior to reaching retirement age and the right to a pension granted on the universal system’s principles. The Ministry of Family and Social Policy in Poland highlights the transitional nature of these pensions as their distinguishing feature.

Who is Eligible for Bridging Pensions?

Presently, bridging pensions are only granted to those who performed work under special conditions or of a special nature before January 1, 1999. However, an amendment to the law on bridging pensions signed by President Andrzej Duda in August repeals this expiring nature, potentially broadening the scope of eligible recipients. Most of the amended provisions will come into effect from January 1, 2024.

Concerns Over Eligibility of Contract Workers

However, a considerable number of individuals who have been employed under special conditions on a contract basis in recent years may not be eligible for these bridging pensions. These include drivers, medical rescuers, and civil aviation pilots. The law stipulates that bridging pensions are only granted to employees who are employed on a permanent basis, potentially leaving contract workers in the lurch.

As a result, it is anticipated that these workers may initiate lawsuits against their employers to establish an employment relationship and gain the right to this benefit. The potential legal battles could pose significant challenges for both the workers seeking their rightful benefits and the government attempting to manage its pension obligations.

Projected Beneficiary Numbers for Bridging Pensions

According to data from the Social Insurance Institution, as of June 2023, the number of people receiving bridging pensions was 40,800. After the repeal of the expiring nature of bridging pensions, it is projected that the number of people transitioning to this benefit will be 7,300 in 2024, 4,000 in 2029, and 4,800 in 2033. This increase in recipients will undoubtedly place a greater financial burden on the Polish government and may require further adjustments to the pension system in the future.

Conclusion

The situation surrounding Poland’s bridging pensions highlights significant issues related to employment contracts and pension rights. As the number of people eligible for these pensions increases, the country must find a way to balance the rights of its workers with the economic realities of providing these benefits. The case of contract workers, who may not presently qualify for these pensions, introduces further complexity into this already intricate issue. It remains to be seen how Poland will navigate these challenges and what changes may be forthcoming in its pension system.
